By accessing or using Swatchd (the "Service"), located at swatchd.app, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service.

2. Description of Service

Swatchd provides AI-powered interior paint consulting. Users may upload room photos for analysis via Anthropic Claude and generate room visualizations via Google Gemini. The Service includes access to paint brand databases, "Colour Reports," and a digital "Palette Workshop."

3. Payment Model & Exploration Credits

Swatchd utilizes a one-time payment model for Day Passes and Project Plans. There are no recurring subscriptions.

• Credits: Certain features, such as generating a Colour Report, consume "Exploration Credits."
• Consumption: Once an AI Diagnosis is initiated or an Exploration Credit is used, the Service is considered "consumed."
• Refunds: Refund eligibility is strictly governed by our Refund Policy.

4. AI-Generated Content Disclaimer

"The Service provides digital suggestions, not professional architectural or interior design advice."

Visualisations and colour matches are AI-generated estimates. Results can vary significantly due to screen calibration and physical room lighting. Always purchase physical paint samples before making final decisions. Swatchd is not liable for costs associated with physical paint applications.

Room Visualisations

Swatchd uses generative AI (Google Gemini) to create visual previews of paint colours applied to your room photos. These visualisations are creative interpretations only and are not photorealistic reproductions of your room.

• Results may vary — surfaces, architectural features, and proportions may not render exactly as they appear in real life.
• AI visualisations are intended as a guide to colour direction only, not an accurate representation of a finished paint job.
• Visualisation credits are consumed upon generation, regardless of the quality of the output. We do not offer refunds or credit replacements for individual renders.
• We have made reasonable efforts to guide the AI with detailed prompting to produce accurate and useful results, but the technology is still evolving and we cannot guarantee specific outcomes.

By generating a room visualisation, you acknowledge and accept these limitations.

5. Intellectual Property

Swatchd and its licensors own all rights, title, and interest in the platform, including the underlying software and proprietary matching algorithms.

User Content: You retain ownership of photos you upload. By uploading content, you grant Swatchd a worldwide, non-exclusive license to host, process, and use that content solely to provide the Service to you.

6. Governing Law & Liability

These terms are governed by the laws of the Republic of Ireland.

To the maximum extent permitted by law, Swatchd is provided "as is" without warranties of any kind. Our total liability for any claim arising from the use of the Service shall not exceed the amount paid by the user for the Service.
